Terms and Conditions & Privacy Policy

01. Definition

  • ① In this terms and regulations for participation, the term “exhibitor” shall include all employees, servants and agents of any individual company, partnership firm or organization who have applied for space for the purpose of exhibiting.
  • ② The term “Fair” shall mean the Gwangju Food Fair 2023(Asia Content and Entertainment Fair 2023)
  • ③ The term “fair management” shall mean Kimdaejung Convention Center in 30 Sangmunurio, Seo-gu, Gwangju, [61958] Republic of Korea

02. Participation

  • ① The exhibitor who wishes to attend the exhibition must submit the application form to the fair management.
  • ② When the application form is submitted, the application fee (booth fee, utility service application fee) must accompany the application form. The contract will take effect when the application fee is paid. In the event that exhibition space is fully occupied, the fair management can reject the acceptance of the application form. Depending on the exhibition circumstance, the fair management can also refund the application fee within 15 days from the date of the acceptance.
  • ③ The exhibitor must notify to the fair management immediately if there is any changes of the documents. If not, the exhibitor will be responsible for the disadvantage that is occurred from it.

03. Space Allocation

  • ① The fair management can determine the allocation of the booth considering exhibitor’s nationality, type of exhibits, company location as well as exhibitor’s choice. The exhibitor can not take exception to the fair management’s decision.
  • ② If there is a particular reason before stand construction, the location and area of booth that was chosen by exhibitor can be changed or reallocated. The exhibitor shall cooperate on demand of the fair management but Force Majeure.

04. Managing Booth

  • ① The exhibitor shall display exhibit items that are stated on the application form. Exhibitors are advised to have their staff(s) look after their own exhibit items.
  • ② If the exhibit items are different from listed ones or do not fit exhibition’s feature, the fair management can have the exhibitor move-out or carry-out. If the exhibitor sells the exhibit items in the booth without prior approval, the fair management can have it stopped. Under this circumstance, the application fee cannot be refunded and the exhibitor cannot claim for it.
  • ③ The fair management, as needed, can restrict particular person(s) from entering the exhibition hall.
  • ④ The exhibitor cannot transfer, resale or exchange all or part of the allocated booth space to other people without the fair management’s approval.
  • ⑤ The exhibitor cannot damage the floor, ceiling, column, wall, etc. in the exhibition venue by painting and gluing. If do that, the exhibitor must be responsible for the damage and the fair management can demand compensation for it.
  • ⑥ The fair management can prohibit or restrict the exhibit items or exhibition activities for maintenance of exhibition order, safety and prevention of troubles.

05. Payment

  • ① The participation fee refers to the total amount of booth rental fee and utility service fee, and the basic participation fee is provided in the application form. The participation fee (booth rental fee and utility service fee) is subject to value-added tax.
  • ② "The exhibitor must pay a 50% deposit of the participation fee (booth rental fee and utility service fee) within 5 days of submitting the application form, and the remaining balance must be paid in full by the application deadline (July 31st, 2023)."
  • ③ In the event that the exhibitor doesn’t settle the application fee including booth fee and utility service application fee, etc, the fair management has the rights to defer the exhibitor’s participation or keep the exhibitor’s exhibit items until the exhibitor pays the full payment.
  • ④ If the exhibitor unavoidably submits the application after the application deadline (July 31st, 2023), they must pay the full participation fee within 5 days of the application submission.

06. Cancellation and/or Change of participation

  • ① In the event that the exhibitor cancels all or part of the booth area, the exhibitor must immediately notify the fair management in writing according to the regulations set by the organizer for cancellation. According to the regulation of Gwangju Food fair, the fair management confirms the cancelation of them.
  • ② If the cancellation notice is received by the application deadline (July 31st, 2023), the organizer will refund 100% of the participation fee received from the exhibitor. If the cancellation be notified later than July 31th (MON), the organization will not refund application fee paid.
  • ③ The application fee paid shall be refunded without interest.

07. Cancellation and / or change of exhibition

  • In the event of cancellation of fair by management, the application fee paid will be refunded. But if the cancellation is caused by force majeure, the fee will not be refunded. The fair management reserves the right to change the venue and duration of the fair of exceptional circumstance demand. In this case, the fee paid will not be refunded and the exhibitor cannot claim for compensation for it.

08. Construction and Exhibit items

  • The exhibitor shall complete the move-in the exhibition venue according the arrangements and within the time specified by the fair management.

09. Move-out

  • The exhibitor shall complete the move-out from the exhibition venue according the arrangement and within the time specified by the fair management, if the exhibitor postpones the move-out, the exhibitor will be totally responsible for the cost of delay.

10. Safety and insurance

  • ① The fair management shall be responsible for the security for exhibitors and visitors.
  • ② The exhibitor shall be solely responsible for damage and theft of exhibit device, items and materials during move-in, move-out and exhibition period.
  • ③ The exhibitor shall be solely responsible for the damage of the fair management and other people that occur by the exhibitor’s intention or negligence. The exhibitor shall be solely responsible for insurance of exhibit items and materials.

11. Fire prevention

  • ① All the materials for exhibition must be fireproofing as the fire act.
  • ② The fair management, as needed, can demand the corrective measures of fire prevention to the exhibitor.

12. Additional Rules and Regulations

  • ① The fair management, as needed, can add condition(s) that is(are) not in the terms and regulations for participation.
  • ② The added condition(s) is(are) also the part of the terms and regulations for participation, the exhibitor shall follow the added condition(s).

13. Settlement of the dispute

  • The Korean Commercial Arbitration Board will arbitrate all disputes in connection with this terms & regulations between the fair management and the exhibitor such as rights and duty. The decision made by the Korean Commercial Arbitration Board shall be taken as final and binding upon both parties. Both of parties cannot complain with the court of the Korean Commercial Arbitration Board’s decision.

TERMS AND REGULATIONS FOR PARTICIPATION

1. TERMS OF REFERENCE

  • A. In these terms and regulations for participation, the term "exhibitor" shall include all employees, servants and agents of any individual company, partner firms or organization which have applied for space for the purpose of exhibition.
  • B. The term "exhibition" shall mean Gwangju Food Fair 2023.
  • C. The term “Organizers “shall mean Kimdaejung Convention Center located in 30 Sangmunuriro, Seo-gu, Gwangju [61958], Korea .

2. APPLICATION FOR PARTICIPATION

  • A. All applications for participation shall be submitted to Organizers.
  • B. The contract shall be established when the exhibitor submits application form and pays the Organizers participation fee of the space only, shell scheme booth or premium booth and utility services charges. The Organizers, however, reserve the right to refuse the acceptance of an application in the event sufficient space is not available, even after payment, and payment shall be returned within 15 days of registration.
  • C. Exhibitors wishing to make alterations to application forms or utility services should contact the Organizers immediately. Failures to do so will any consequences thereof are the sole responsibility of the exhibitor.

3. ALLOCATION OF EXHIBIT SPACE

  • A. All final decisions on allocation of booths will be made solely by the Organizers in order of registration, payment, nationality, exhibit, size of the space applied for or in the manner the Organizers deem fit.
  • B. Organizers shall reserve the right to change the location and/or the size of the space allocated to the exhibitor at any time prior to the commencement of the setup of the exhibition, should exceptional circumstances demand, and the exhibitor shall have no claim for compensation as a result of the changes.
  • C. Under no circumstances may the exhibitor resell, transfer rights to, or enter into a mutual agreement to change assigned booth(s) with another party, without the prior approval of the Organizers.

4. MANAGEMENT OF EXHIBIT SPACE

  • A. Exhibitors are bound to exhibit the pre-registered products and to staff the exhibits with competent personnel during the entire period of the exhibition.
  • B. All exhibits must follow the application form, and be related to the theme of the exhibition. Direct sales without prior approval from the booth are strictly prohibited. If the exhibitor violates the above-mentioned rules, the Organizers can stop the exhibitor's activity, remove his/her exhibits or order the dismantling of his/her booth. In this case, the participation fee shall not be refunded and the exhibitor shall hold no claim to compensation.
  • C. Organizers reserve the right to refuse admittance to the exhibition to any person.
  • D. Exhibitors are not allowed to sublet space allotted to them to a third party, either wholly or in part, without the prior written consent of the Organizers.
  • E. Modifications including decorations such as painting of floors, ceilings and/or pillars will not be permitted, and exhibitors doing so shall be held liable to compensate the Organizers for consequent damages to the exhibition hall.

5. TERMS OF PAYMENT

  • A. A 50% deposit of the participation fee and/or relevant stand charges must be paid within a week of application form submission by the exhibitor. The balance shall be paid no later than September 14, 2023. After September 14, 2023, payments should be completed immediately.
  • B. The participation fee must be paid by the due date; otherwise the Organizers reserve the right to cancel the contract. In such a case, prior payment of participation fees will not be refunded.

6. CANCELLATION OF EXHIBITION SPACE

  • In the event of the Organizers agreeing to any request for release from the Contract, the Exhibitor will be liable for all or part of the cost stated in the Contract overleaf on the following scale:
  • Cancellation before September 14, 2023 50% of cost
  • Cancellation after September 15, 2023 / FULL COST
  • About refund value, the Organizer not be liable for interest payment.
  • This scale of charges will apply only from the date the Organizers receive written notice by letter or fax. In addition to this scale, the Exhibitor will be liable for any specific cost incurred on his behalf by the Organizers. These terms cannot be varied under any circumstances.

7. FAILURE TO EXHIBIT

  • Any organization which, having signed a contract for exhibition space, fails to exhibit whether or not for any reason of the Exhibitor's own choosing and has not been released from the contract by the Organizers shall be liable for the full amount stated in the contract plus any additional costs incurred by the Organizers as a result of such failure to exhibit.

8. CONSTRUCTION AND DECORATION OF BOOTH AND DISPLAY

  • All exhibitors must complete construction and/or decoration, and move-in and display of exhibits by the date and time stipulated by the Organizers.

9. MOVEMENT OF EXHIBITS AND BOOTH FITTINGS

  • Exhibitors shall remove all exhibits and booth fittings from the exhibition hall within the period stipulated by the Organizers and indemnify the Organizers against any costs incurred by reason of delay or damage to the exhibition hall.

10. EXHIBITOR'S INSURANCE

  • Exhibitors shall make sure that they are fully covered by insurance including, but not restricted to, all risks on their property, exhibits or articles of any kind, public liability and comprehensive protection against any loss or damage caused by any circumstance whatsoever whether by reason of fire, water, theft, accident or any other cause. The Exhibitor shall insure against, indemnify and hold the Organizers harmless in respect of all costs, claims, demands and expenses to which the Organizers may in any way be subject as a result of any loss or injury arising to any person (including members of the public or the Organizers' staff, agents or contractors) or property howsoever caused as a result of any act or default of the Exhibitor, his servants, agents or contractors or invitees. If the Organizers so demand the Exhibitor shall provide proof to the Organizers that the Exhibitor has adequate insurance cover. Exhibitors must ensure that their temporary staff and the staff of their servants, agents or contractors are insured against claims for workman's compensation. The period for which such insurance shall be maintained shall run from the time the Exhibitor or any of his servants, agents or contractors first enters the exhibition grounds, and to continue until he has vacated the exhibition grounds and all his exhibits and property have been removed.

11. FIRE REGULATIONS

  • A. Materials used in booth and display construction must be properly fire-proofed in accordance with the regulations of Korea.
  • B. The Organizers have the right, should circumstances necessitate, to make changes in the exhibitor's booth in the interest of fire control.

12. SUPPLEMENTARY CLAUSES

  • A. Whenever necessary, the Organizers shall have the right to issue supplementary regulations, in addition to those in the terms and regulations, for participation in Gwangju Food Fair 2023 to ensure smooth management of the exhibition.
  • B. Any additional written regulation or instructions shall form part of the terms and regulations for participation in Gwangju Food Fair 2023 and be binding on all exhibitors.
  • C. The exhibitor shall also observe stipulated regulations for management of exhibition halls of Kimdaejung Convention Center, Korea.

13. ARBITRATION OF DISPUTES

  • Any dispute, difference, or question which may arise at any time hereafter between the Organizers and the exhibitor related to interpretation of terms and regulations for participation, or rights and liabilities of the parties hereto, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the Korean Commercial Arbitration Board in Seoul, Korea. Awarding of the above arbitration shall be final and binding upon both parties
